Terms and Conditions for Participation in Recreational and Tourist Activities

These terms and conditions apply to anyone who wishes to participate in the recreational and tourist activities offered by Panama Diverso Tours & Services.

Risk Acceptance: By participating in our recreational and tourist activities, you acknowledge and accept the risks associated with these activities, including but not limited to injury, disability, death, property damage, and any other form of loss, whether caused by negligence or not.
Full information: You acknowledge and agree to have received full information about the risks and hazards inherent in the recreational and touristic activities we offer, including but not limited to the risks of injury caused by the equipment used, possible equipment failure and/or malfunction, and risks related to exposure to elements such as extreme heat, hypothermia, bodily impact with water, water entry through bodily orifices, tripping over natural or man-made objects, exposure to animals, among others.
Responsibility of Participant: You agree that you are responsible for your own safety and well-being while participating in our recreational and touristic activities. You agree to follow all instructions of Panama Diverso Tours & Services staff and to comply with rules and regulations established by the company.
Release of Liability: You release and discharge Panama Diverso Tours & Services, its employees, directors, representatives, agents, boats, and all those connected to the service, from any and all liability, claims, demands, damages, or causes of action, whether known or unknown, arising out of or related to any loss, damage, injury, disability, death, or other harm to person or property, whether caused by negligence or otherwise.
Indemnification: You agree to indemnify, defend, and hold harmless Panama Diverso Tours & Services, its employees, directors, representatives, agents, boats, and all those related to the service, from any claim, legal action, or demand arising from or related to your participation in our recreational and touristic activities.
Modifications: Panama Diverso Tours & Services reserves the right to modify these terms and conditions at any time and without prior notice. Any modifications will be effective immediately after their publication on our website.
Applicable Law: This agreement shall be governed and interpreted in accordance with the laws of the Republic of Panama, without regard to its conflicts of laws.
Participant's Obligations: The participant agrees to follow all instructions given by the guides and/or company personnel. The participant also agrees to inform the guides and/or company personnel of any injury or illness they have prior to participating in the recreational activities.
Age Restrictions: Some activities may have age restrictions for participation. Participants under the age of majority must be accompanied by a responsible adult and must have the consent of their parents or legal guardians.
Weather Conditions: The company reserves the right to cancel or modify any activity in case of bad weather or other adverse weather conditions. Participants should be prepared for any changes in the planned activities.
Equipment: The company will provide the necessary equipment for the recreational activities, which must be used in accordance with the instructions given by the guides and/or company personnel. Participants agree to pay for any damage or loss of equipment provided by the company, caused by their negligence or misuse.
Third-Party Waiver of Liability: Participants release the company from any liability for any injury, damage or loss caused by third parties, such as other participants, facility users or external service providers.
Dispute Resolution: In the event of any dispute or claim related to the terms and conditions, participants agree to resolve the matter through alternative dispute resolution methods such as mediation or arbitration.
Applicable Law: The terms and conditions shall be governed and interpreted in accordance with the laws of the country where the recreational activities take place.
